These Terms of Use govern access to and use of the Curated Nilgiris website and platform (the “Platform”). By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any part of these Terms, you must discontinue use of the Platform immediately.

Curated Nilgiris reserves the right to update or modify these Terms of Use at any time. Continued use of the Platform following any changes constitutes acceptance of the revised terms.

1. Platform Purpose
Curated Nilgiris operates as an independent digital discovery platform dedicated to documenting and showcasing distinctive places, businesses, makers, experiences, and entrepreneurial ventures located within the Nilgiris district.

The Platform is editorial in nature and is designed to highlight enterprises that demonstrate originality, authenticity, quality of experience, and meaningful contribution to the cultural and economic landscape of the region. The Platform is not intended to function as an exhaustive business directory, and inclusion of businesses is selective and editorially determined.

2. Acceptance of Terms
By accessing the Platform, submitting information, browsing listings, or otherwise interacting with the website, users agree to comply with these Terms of Use and any additional policies referenced herein, including but not limited to the Privacy Policy, Content Policy, Business Submission Agreement, Anti-Scraping and Automated Access Policy, and Database Rights and Data Protection Statement. Users are responsible for ensuring that their use of the Platform complies with applicable laws and regulations.

3. Intellectual Property Rights
All materials and content appearing on the Platform, including but not limited to written text, editorial descriptions, photographs, visual assets, design elements, platform structure, layout, logos, graphics, and database organisation, are the intellectual property of Curated Nilgiris unless otherwise stated.
The compilation, organisation, categorisation, and presentation of listings on the Platform constitute proprietary intellectual property owned by Curated Nilgiris. No part of the Platform may be copied, reproduced, republished, distributed, transmitted, displayed, or otherwise used for commercial purposes without the prior written consent of Curated Nilgiris.

4. Prohibited Activities
Users agree not to engage in any activity that interferes with the proper functioning of the Platform or violates intellectual property rights.

Without limitation, the following activities are strictly prohibited:
• scraping, crawling, or extracting data from the Platform
• copying listing descriptions or editorial content
• reproducing images, photographs, or media without permission
• replicating the Platform’s database, structure, or content organisation
• redistributing Platform content for commercial use
• using automated systems, bots, or software to collect information from the Platform
Automated scraping, indexing, or extraction of data from the Platform without express written permission from Curated Nilgiris is strictly prohibited.

5. Platform Content
Curated Nilgiris provides information for discovery and informational purposes only. While reasonable efforts are made to maintain accurate and up-to-date information, Curated Nilgiris does not guarantee the accuracy, completeness, availability, or quality of services offered by any listed business.
Users are encouraged to independently verify details, including operating hours, pricing, and service availability, before engaging with any listed business.

6. Modification of Platform
Curated Nilgiris reserves the right, at its sole discretion, to modify, update, suspend, or discontinue any part of the Platform, including listings and editorial content, at any time without prior notice.

7. Limitation of Liability
To the maximum extent permitted by law, Curated Nilgiris shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use of the Platform or from interactions with businesses listed on the Platform.
Users acknowledge that engagement with businesses featured on the Platform occurs independently and at their own discretion.

8. Governing Law
These Terms of Use shall be governed by and interpreted in accordance with the laws of India. Any disputes arising in connection with the Platform shall fall under the jurisdiction of the courts located in Tamil Nadu, India.
